On August 1, eight departments, including the National Development and Reform Commission, issued a circular on the implementation of a number of recent measures to promote the development of the private economy. The circular puts forward 28 measures from the aspects of promoting fair access, strengthening factor support, strengthening the guarantee of the rule of law, optimizing enterprise-related services, and creating a good atmosphere, in order to solve the outstanding problems faced in the development of the private economy, stimulate the vitality of the development of the private economy, and boost confidence in the development of the private economy.


I. promoting fair access


1. In the national major projects and deficiency board projects, select projects with a certain level of income and relatively mature conditions to form a list of major projects that encourage the participation of private capital. By holding major project promotion meetings and opening columns on the national investment project online examination and approval supervision platform, we will centrally release project information to private enterprises and actively guide the implementation of the project. In comparison with the above-mentioned measures, various regions have formed a list of projects that encourage the participation of private capital and strengthen their promotion.


two。 We will expand the issuance of real estate investment trusts (REITs) in the infrastructure sector, promote qualified private investment projects to issue infrastructure REITs, and further expand private investment.


3. We will support private enterprises to participate in major scientific and technological research, and take the lead in tackling key tasks in the areas of industrial software, cloud computing, artificial intelligence, industrial Internet, genetic and cellular medicine, and new energy storage.


4. Enhance the supply capacity of private enterprises in the key links of the industrial chain supply chain, and cultivate a number of characteristic industrial clusters of small and medium-sized enterprises in the county area of the country.


5. We will promote the healthy development of the platform economy and continue to launch the "green light" investment cases of platform enterprises.


6. Support to specialize in the new "Little Giant" enterprises and high-tech enterprises to put on record at the local national intellectual property protection center to carry out rapid pre-examination, rapid determination of rights, and rapid protection of rights.


7. We will carry out the certification and upgrading of the quality management system of private enterprises to enhance the quality and technological innovation capability of private enterprises. Support private enterprises to take the lead in the establishment of international industrial and standards organizations. We will continue to carry out the activity of "Metrology Service for small and medium-sized Enterprises", support private enterprises to participate in the construction of industrial measurement and testing centers, and enhance the advanced measurement capabilities of private enterprises.


8. In accordance with the requirements of the "measures to help small and medium-sized enterprises stabilize their growth and strengthen their structure" (Ministry of Industry and Information Technology Enterprise letter (2023) No. 4), extend the policy period of raising the reserved share of government procurement projects for small and medium-sized enterprises to more than 40% until the end of 2023. Speed up the progress of contract payment and use credit guarantee to facilitate the participation of small and medium-sized enterprises in procurement activities.


9. We will carry out special measures to deal with the outstanding problems in tendering and bidding for engineering construction, and adopt measures such as administrative penalties, supervision and rectification, and notification of cases, so as to focus on solving the problems of local protection and ownership discrimination reflected strongly by a number of private enterprises. Support all regions to explore the application of electronic business license in bidding platform login, signature, online contract signing and other business.


10. We will revise and issue a new negative list of market access to promote all kinds of business entities to equally enter industries, fields and businesses that are not on the list in accordance with the law.


Second, strengthen the support of elements


11. On the basis of the two time points of the enterprise income tax prepayment reporting period in October of that year and the settlement and payment period from January to May of the following year, the reporting period of advance payment in July of that year shall be increased as the time point of the enjoyable policy, and enterprises in industries that meet the requirements may declare and enjoy the R & D expenses plus deduction policy in accordance with the regulations.


twelve。 Continue to ensure that the average processing time for normal export tax rebates of export enterprises is within 6 working days, and reduce the average time for normal export tax refund (exemption) of class I and category II export enterprises to 3 working days until the end of 2024. Update and issue national (regional) investment tax guidelines to help private enterprises better guard against cross-border investment tax risks.


13. We will extend the term of the inclusive small and micro loan support facility to the end of 2024, and continue to increase inclusive financial support. Guide commercial banks to access financing and credit service platforms such as "credit-for-loan" and local credit platform, and strengthen inter-departmental credit information connectivity. Expand the scale of credit loans for private enterprises. We will effectively implement the management system for the write-off of bad debts in financial enterprises.


14. Expand the new model of central-local cooperation and credit enhancement of private enterprise bonds to all kinds of private enterprises that meet the issuance conditions, and form more demonstration cases as soon as possible.


15. To meet the land demand of private small and medium-sized enterprises, explore the implementation of industrial chain land supply, and implement the overall supply of land for many related projects in the industrial chain.


16. In addition to laws and regulations and relevant policies, within the scope of urban planning and construction land, the investment interface of water supply and gas supply enterprises extends to the red line of enterprise building zoning free of charge.


17. Private enterprises shall be given the right to evaluate professional titles, and private enterprises with strong technical strength are allowed to set up professional title evaluation committees individually or jointly to carry out independent evaluation.


III. Strengthening the guarantee of the rule of law


18. We will clean up and abolish regulations and normative documents that violate the principle of equal protection of the economy of all forms of ownership, and strengthen the protection and support for the development of the private economy.


19. According to Article 33 of the Administrative punishment Law of the people's Republic of China, the specific circumstances of non-punishment are clearly defined in key areas such as urban management, ecological environmental protection, market supervision and so on. The guiding opinions on further standardizing and supervising the setting and implementation of administrative fines will be issued. Special clean-up of fine items in administrative regulations and departmental rules shall be carried out, and the results of the clean-up shall be announced to the public.


IV. Optimize enterprise-related services


20. We will comprehensively build a pro-Qing relationship between government and business, support various regions to explore ways to serve private enterprises in different ways, make full use of digital means such as the national integrated government service platform to enhance the policy and service efficiency of benefiting enterprises, and take more measures to help private enterprises solve their problems.


21. To establish a management system for the list of intermediary service items related to enterprise-related administrative license, all items that are not included in the list will no longer be taken as conditions for acceptance of administrative examination and approval. If new ones are really needed in the future, they shall be set up in accordance with legal procedures and included in the list management. Bring intermediary service items into the integrated government service platform at all levels, realize the full process of organization selection, fee payment, report upload, service evaluation and so on, and accept social supervision openly.


twenty-two。 We will step up efforts to clean up the accounts owed to private enterprises, with emphasis on clearing the accounts owed by government organs, institutions and state-owned enterprises to small and medium-sized enterprises. The audit department accepts the arrears clues reflected by private enterprises and strengthens the audit supervision.


23. We will fully implement the system of simple cancellation and general cancellation, and improve the "one-network service" platform for enterprise cancellation. We will improve the supporting policies and measures for the closure system.


24. In addition to the need for confidentiality in accordance with the law, the formulation and revision of enterprise-related policies should fully listen to the opinions and suggestions of entrepreneurs. A reasonable transition period should be set for the adjustment of enterprise-related policies.


Fifth, create a good atmosphere


25. The channels of enterprise-related complaints are unblocked at different levels, special announcements on enterprise-related issues are set up on the "Internet + Supervision and Inspection" platform of the State Council, and enterprise-related issues solicitation columns are set up on the complaint and suggestion system of the national government affairs service platform. bring business-related complaints into the "12345" hotline and other government service platforms, and establish a follow-up mechanism for rectification and reform. Continue to carry out the work of evaluating the business environment of ten thousand private enterprises.

twenty-seven。 Include the implementation of support for the development of the private economy in various regions into the annual comprehensive supervision and inspection of the State Council, supervise and rectify the problems found, and publicize and promote good experiences and practices. A special incentive and support program for investment promotion and private investment within the central budget will be set up to provide incentive support to a number of cities and counties with fast growth, high proportion, strong vitality and practical measures for private investment every year.
